Refunds and Pass Transfers
There are no refunds for Lindyfest tickets. Transfer of event passes; including dance passes, track classes, competitions, community brunch, and add-on classes; to another person may be initiated through your registration profile until Wednesday, March 15th. Please e-mail LFregistration@hsds.org to initiate a transfer to Lindyfest 2024. Transfers are only good for 1 year.
Competitions
Competitions are all about fun (and are not to be used as a measure of self-worth!). However, competitions often involve dancing with people you have never met before. By competing, you recognize that competitions entail a degree of risk, as would any athletic activity.
We do not refund competition fees if you change your mind, or cannot attend the event.
Awarded Passes
Some dancers may be awarded passes to Lindyfest. Awarded passes are non-transferable and cannot be credited toward future years if you cannot attend. Awarded passes cover entry into the weekend event and dances, but do not include the price of competitions or any extras.
Risk & Liability
By signing up, attending, and/or participating in dance classes, dance parties, or any event or program, current or future, organized by The Houston Swing Dance Society 501(c)(3) at any location, you hereby agree to the following:
Injury, Illness, and COVID-19 Acceptance of Risk and Waiver of Liability and Media Release
In consideration of being allowed to participate in the events and activities conducted in conjunction with The Houston Swing Dance Society, Inc. (“HSDS”) and other dance organizations in association with HSDS (the “Activities”), and receipt of HSDS’ associated benefits and other good and valuable consideration, the undersigned acknowledges, appreciates and agrees that:
I recognize that I am being provided access to the Activities as a benefit to me for the purpose of recreational enjoyment in Activities, but for no other purpose.
I recognize there are certain inherent risks associated with engaging in the Activities and that the risk of injury or illness from my use may be significant, including without limitation, the potential to contract an infectious or communicable disease, personal injuries, and/or heart attack, cardiac arrest, and death. As an express precondition of my participation in activities I acknowledge and agree that although the organizer cares deeply about the health and well-being of all participants and their families, the organizer cannot guarantee that Covid-19 or any other virus or disease will not be contracted by participants or their families. In consideration of the opportunity to participate in dancing activities, I hereby agree to release, hold harmless and waive any and all claims against the organizer or other participants from any and all claims or liability arising out of this participation; and
I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM MY NEGLIGENCE OR THE NEGLIGENCE OF RELEASEES OR OTHERS, and assume full responsibility for my participation; and
I willingly agree to observe and comply with all terms and conditions of the Activities and HSDS’ Code of Conduct generally. Additionally, if I am not feeling well at the time of desired participation in the Activities or I have been in close contact with a person not feeling well, I will not participate in the Activities; and
I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY WAIVE, DISCHARGE AND RELEASE AND AGREE TO INDEMNIFY AND HOLD HARMLESS The Houston Swing Dance Society, Inc. and any and all affiliates and their respective employees, officers, and/or agents (all hereinafter referred to as “Releasees”), FROM AND AGAINST ANY AND ALL CLAIMS, CAUSES OF ACTION, LOSSES, COSTS AND EXPENSES ARISING OUT OF OR RELATED TO ANY INJURY, DISABILITY, DEATH, or loss or damage to person or property, ARISING OUT OF, RELATED TO OR RESULTING FROM MY PARTICIPATION IN THE ACTIVITIES, EVEN IF ARISING OUT OF, RELATED TO OR CAUSED BY ANY NEGLIGENCE OF ANY ONE OR MORE OF THE RELEASEES;
I consent to receive medical treatment which may be deemed advisable in the event of injury, accident, and/or illness during my participation in the Activities; and
Any legal or equitable claim that may arise from my participation in the Activities shall be resolved under Texas law. This release shall be construed broadly to provide a waiver, release, assumption of risk and indemnification to the maximum extent permissible under applicable law. If any portion of this release is held invalid, the remainder shall continue with full legal force and effect.
I understand while participating in the Activities, I may be photographed. I agree to allow my photo, video, or film likeness to be used for any legitimate purpose by the activity holders, producers, sponsors, organizers, and assigns.
Changes in Schedule
The attendee acknowledges and accepts that the schedule is subject to change, and Lindyfest is not liable for any losses or damages incurred by schedule changes.
Parental Consent
All attendees under 18 must submit written consent, which needs to be signed and dated by their parent or legal guardian. Email us at LFregistration@hsds.org for further information.
Filming Classes
Filming and photography of class content are only allowed with the express consent of the instructors. Typically at the end of class, the instructors will allow a video recap or review and we know these are super helpful in our growth as dancers! Please do not film during the class and please do not post video class reviews to the internet in a publicly-available fashion, unless the instructors give explicit consent.
You may be filmed or photographed by a member of the Lindyfest Staff for promotional purposes.
Filming Performances and Evening Dances
We hire a professional videographer each year to capture the beautiful moments created at our event. As such, only hired staff is allowed to film using professional-grade equipment. Filming with smartphones or similar-caliber devices is okay. Filming and photography are allowed during performances, competitions, and evening dances. Please refrain from using flash photography during performances, competitions, and classes. It is very distracting to the dancers.
Privacy Policy
The privacy of your data is important to us. Lindyfest only stores information relevant to your registration details and the information necessary to contact you. We do not store personal credit card or banking information in our registration database. We only store your method of payment. We will not sell your personal information. We may contact you in reference to future events using the information you have provided in the past. If you do not wish to receive these communications, you must notify us in writing.
